Answer
The EU Carbon Border Adjustment Mechanism (CBAM) came into effect on 1 January 2026.
In regard to any potential impact on the trade in electricity, in respect of movement from GB into NI, there will be no CBAM liability, given that the EU CBAM Regulation does not fall within scope of the Windsor Framework.
There will also be no CBAM liability on electricity imported into RoI from NI, as both jurisdictions are subject to the same carbon price under the EU Emissions Trading System (ETS) (electricity generating installations in NI continue to participate in the EU ETS under the terms of the Windsor Framework, to protect the operation of the all Ireland Single Electricity Market).
